Mahramiyat by Marriage (Arabic: مَحرَمیت سَبَبی) is a relationship created through the contract of marriage,[1] intercourse by mistake (wat' al-shubha),[2] or adultery between a man and a woman and some of their relatives,[3] as well as through looking at or touching a concubine.[4] This concept is known in jurisprudential books under the title "musahara" (affinity).[5]
Rulings and Instances of Mahramiyat by Marriage:
- Eternal Prohibition: Marrying those who are mahram through marriage, such as the mother-in-law, is eternally forbidden.[6]
- Marriage Restrictions: Marrying the wife's sister (as long as her sister is in his marriage or is alive)[7] and also marrying the wife's niece (daughter of her brother or sister) without her permission is not permissible.[8]
- Looking: Looking at those who are mahram through marriage and the revealing of their ornaments to them is permissible.[9]
- Inheritance: Mahramiyat by marriage is considered one of the causes of inheritance that is established through the contract of marriage.[10]
List of Mahrams through Marriage from the perspective of Shi'a Jurists:
- The wife's mother and grandmothers (even without consummation with the wife).[11]
- The son's wife (daughter-in-law).[12]
- The father's wife (stepmother) and the grandfathers' wives.[13]
- The stepdaughter (wife's daughter from a previous husband)[14] and her daughters and her female grandchildren.[15]
- The husband's father and grandfathers (father-in-law).[16]
- The husband's sons (stepsons).[17]
- The daughter's husband (son-in-law).[18]
