Mujtahid al-Mutajazzi

Al-Mujtahid al-Mutajazzī (Arabic: المجتهد المتجزّئ, lit. partial mujtahid) is a person who has the ability of inferring religious rulings only in a part of jurisprudential issues,[1] unlike a al-Mujtahid al-Mutlaq (absolute jurist) who can infer all Religious rulings.[2] Most jurists believe that ijtihad in specific jurisprudential areas is possible, and an al-Mujtahid al-Mutajazzi can perform ijtihad in a specific field without having complete mastery over fiqh.[3] However, some jurists consider it rationally impossible.[4]
According to jurists, when a partial mujtahid reaches a definitive ijtihad in an issue, acting upon his own opinion is obligatory for him, and he cannot practice Taqlid (emulate) others.[5] There are two views regarding the permissibility of others doing Taqlid of a Mujtahid al-Mutajazzi: A group believes that one can refer to his ijtihad, and he can be recognized as a Marja' in specific issues.[6] However, others do not consider Taqlid of such a jurist permissible,[7] because the Sira of Rational People or the Sira of the Mutasharri'a does not involve referring to a partial mujtahid, and the evidences for the permissibility of Taqlid do not include him.[8]
Guardianship (Wilaya) and undertaking jurisprudential and judicial affairs are exclusive to a fully qualified jurist, and individuals lacking complete ijtihad can only judge in the absence of an Absolute Mujtahid .[9]
