Recommended Precaution (al-iḥtiyāṭ al-mustaḥabb) in Sharia rulings, unlike Obligatory Precaution,[1] is not binding, and its observance is recommended. In jurisprudential books, it is sometimes referred to with phrases such as yajūzu ʿalā ishkāl (it is permissible despite the problem) or yajūzu ʿalā taʾammul (it is permissible despite the need for reflection).[2]

According to jurists, recommended precaution is always accompanied by a Fatwa; meaning the follower can choose between acting on the fatwa or observing the precaution, but has no right to refer to another Mujtahid. An example is washing a ritually impure vessel in Kurr water which becomes pure with a single wash, although the recommended precaution is to wash it three times. In contrast, obligatory precaution is without a fatwa, and in such cases, the follower can refer to the fatwa of another mujtahid; such as the precaution of not performing prostration (sajda) on the fresh leaf of a grapevine.[3]

Jurists consider the basis and reason for observing precaution in Sharia rulings to be the praise of it in certain traditions of the Infallible Imams (a).[4] Among these is a statement from Imam Ali (a) who said: "Your religion is your brother, so exercise precaution for your religion as much as you wish";[5] meaning your religion is like your brother, so watch over it and be cautious regarding it as much as possible. And the statement of Imam al-Sadiq (a): "In every matter where it is possible, observe the side of precaution."[6]
